Artificial intelligence in criminal law and the challenges for privacy protection

Abstract

OBJECTIVE: to identify the impact of artificial intelligence on the criminal process and its implications for privacy protection. METHOD: descriptive analytical. RESULTS: It is established that artificial intelligence can have both negative and positive effects on the privacy of individuals involved in criminal proceedings. CONCLUSION: It is important to consider that, for the effective achievement of the goals of artificial intelligence, the responsible and ethical use of the data obtained is necessary, aimed at safeguarding security and proper handling, in all cases avoiding the violation of the guarantees provided for every individual immersed in a process as a result of data manipulation.

Student of the Master's Program in Criminal Procedural Law at the University of San Carlos of Guatemala, Zacapa University Center. Graduate of the Bachelor's Degree in Legal and Social Sciences, Lawyer and Notary Public, from the University of San Carlos of Guatemala, Northern University Center.
